1 Introduction
Welcome to MAQAMAT. These Terms & Conditions govern your access to and use of the MAQAMAT platform, website, mobile applications, and all related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms.
MAQAMAT is a location-based digital platform that connects musicians and entertainment professionals with companies, hotels, event planners, and individuals across the UAE and beyond.
2 Definitions
– **Platform:** Refers to the MAQAMAT website, applications, and services.
– **Musician:** Any individual or group registered on the Platform offering musical or entertainment services.
– **Client:** Any company, hotel, event planner, or individual who books entertainment services through the Platform.
– **Booking:** A confirmed agreement between a Client and a Musician for a specific event.
– **Commission:** The platform service fee retained by MAQAMAT for facilitating a successful booking.
3 User Eligibility
To use the Platform, you must be at least 18 years old and legally capable of entering into binding contracts under the laws of the UAE. By using the Platform, you represent and warrant that all information you provide is accurate and complete.
4 Platform as a Business
MAQAMAT operates as a business-to-business and business-to-consumer (B2B & B2C) marketplace. The Platform facilitates introductions, communication, and secure transactions between Musicians and Clients but does not itself provide entertainment services.
5 Registration & Accounts
– Users must register and create an account to access Platform features.
– You are responsible for maintaining the confidentiality of your account and password.
– You agree to provide accurate, current, and complete information and to update it as necessary.
6 Bookings & Agreements
– Clients may browse profiles, request availability, and submit booking requests.
– A booking is confirmed only when both the Musician and the Client (Company/Hotel) accept the terms, date, time, and price through the Platform.
– All event details, communications, and agreements must remain within the Platform’s messaging system.
– Sharing personal contact information or processing payments outside the Platform is strictly prohibited and may result in account suspension or termination.
7 Commission Structure
MAQAMAT is a business-based platform. When a booking is confirmed and accepted by both the Musician and the Client (Company/Hotel):
(25%) — Platform Commission (MAQAMAT)
(75%)— Musician Payout
– MAQAMAT will retain twenty-five percent (25%) of the total booking amount as a service fee.
– Seventy-five percent (75%) of the total booking amount will be paid to the Musician.
– The commission is applied only to confirmed and completed bookings.
– All payments are processed securely through the Platform and held in escrow until the event is successfully completed.
8 Payments & Escrow
– Clients must make payments through the Platform using approved payment methods.
– Payments are held securely in MAQAMAT’s escrow system.
– Funds are released to the Musician (75%) and to MAQAMAT (25%) only after the event is completed.
– If an event is canceled according to this Terms, refunds (if applicable) will be processed as per our Cancellation Policy.
9 Cancellations
– Cancellation terms are defined at the time of booking.
– Cancellations must be made through the Platform.
– Refunds, if applicable, will be issued according to the cancellation policy communicated during booking.
10 Cancellation Terms & Cancellation Policy
Cancellation Terms
1. All booking cancellations must be submitted through the MAQAMAT platform only.
2. Cancellation requests made outside the platform, including direct communication between the Client and the Musician, shall not be considered valid.
3. Cancellation conditions and refund eligibility may vary depending on the booking type, event date, artist category, and specific agreement between the parties.
4. MAQAMAT reserves the right to review all cancellation requests and determine the appropriate resolution based on platform policies and booking circumstances.
5. Repeated cancellations, abuse of the cancellation system, or fraudulent booking behavior may result in account suspension or permanent termination.
Cancellation Policy
**For Clients (Hotels / Companies / Individuals)**
– Cancellations made more than seven (7) days before the event may qualify for a partial or full refund, depending on the musician’s cancellation terms.
– Cancellations made within seven (7) days of the scheduled event may be subject to cancellation charges or partial refunds only.
– Cancellations made within forty-eight (48) hours before the event may be considered non-refundable unless exceptional circumstances apply.
– If the Musician fails to attend the event without valid justification, the Client may receive a full refund or replacement performer support from MAQAMAT.
**For Musicians**
– Musicians are expected to honor all confirmed bookings accepted through the platform.
– Cancellation by a Musician after confirmation may negatively affect profile ranking, reviews, and future booking visibility.
– Repeated cancellations or no-show incidents may result in penalties, temporary suspension, or permanent removal from the platform.
Refund Processing
– Approved refunds will be processed through the original payment method used during booking.
– Refund processing times may vary depending on the payment gateway or banking provider.
– Platform service fees and administrative charges may be non-refundable in certain cases.
Force Majeure
MAQAMAT shall not be held liable for cancellations caused by circumstances beyond reasonable control, including but not limited to:
– natural disasters
– government restrictions
– public emergencies
– venue closures
– travel bans
– or technical failures affecting the event.
In such cases, MAQAMAT will attempt to facilitate rescheduling or provide alternative solutions where possible.
